L,"1 ci <br /> APPLICATION FOR CHANGE OF ZONING CLASSIFICATION <br /> TO: Dane County Board of Supervisors <br /> The Town Board of the Town of Oregon respectfully petitions the Dane County Board <br /> of Supervisors to rezone the following listed properties to the A-3 Agriculture District from <br /> their current designation as A-1 Exclusive Agriculture: <br /> Please see attached Exhibit A listing of specific parcels <br /> Background. In July of 1994, the Town Board of the Town of Oregon adopted two <br /> major policies. In the first, the Town adopted an amended Land Use Plan. This Plan placed <br /> approximately 83% of the Town within planning areas applying a development policy with <br /> densities at the Agriculture-Exclusive level. In addition, the Land Use Plan implemented a <br /> Groundwater Recharge overlay area additionally restricting rural development in areas of the <br /> Town in which groundwater recharge was a significant concern. The Dane County Regional <br /> Planning Commission duly reviewed and approved the Plan by adopting the amendment as <br /> an amendment to the Dane County Farmland Preservation Plan on November 10, 1994. <br /> The second action taken by the Town was, for the first time, to adopt A-1 Exclusive <br /> and A-3 zoning in areas then-zoned A-1 Non-Exclusive. A Petition was submitted to the Dane <br /> County Board consistent with the Town-wide adoption of A-1 Exclusive and A-3. During the <br /> review process, however, apparently through inadvertence, a copy of the Town of Oregon's <br /> original Petition and listing of properties were replaced with a Petition and property listing <br /> that failed to implement the A-3 zoning that the Town of Oregon had submitted. It does not <br /> appear that the Zoning Committee, County Board of Supervisors or the Oregon Town Board <br /> were aware of the inadvertent deletion of the A-3 rezonings at the time that they occurred. <br /> Zoning Petition 6123 was adopted by the County Board of Supervisors on December 15, 1994, <br /> approved by the County Executive on December 19, 1994 and approved by the Oregon Town <br /> Board on January 5, 1995. <br /> During a recent review of the Oregon Land Use Plan by the Department of <br /> Agriculture, Trade and Consumer Protection, the Department questioned the inconsistency <br /> between the A-3 planning category identified in the Oregon Land Use Plan and the absence <br /> of A-3 zoned parcels in the Town of Oregon. <br /> A copy of the Town of Oregon's original Petition and attachment describing the parcels <br /> to be rezoned are attached hereto as Exhibits B and C. <br /> Purpose. This Petition is submitted solely to correct the erroneous deletion of the A-3 <br /> rezonings that were supposed to occur at the time the County Board of Supervisors approved <br /> 931531-21eb-221096kka <br /> Zoning pet <br />
