STAFF REPORT <br /> Prepared by the Department of Agriculture, <br /> Trade and Consumer Protection <br /> Amendment of the Town of Oregon <br /> Exclusive Agricultural Zoning Ordinance Map <br /> December 2, 1996 <br /> Background <br /> Dane County submitted a proposed Town of Oregon zoning map as an amendment to the Dane <br /> County zoning ordinance for certification by the Land and Water Conservation Board (LWCB). <br /> Dane County Action <br /> On December 15, 1994, the Dane County board of supervisors adopted a zoning map <br /> amendment for the Town of Oregon. The map did not include any A-3 Agricultural Transition <br /> districts although such districts were called for in the plan amendment map adopted earlier that <br /> year. The plan map and zoning map were inconsistent in other areas as well. On October 6, <br /> 1995, Dane County submitted this zoning map amendment for certification by the LWCB. <br /> During the last year, the department has worked with representatives from the Dane County <br /> Planning and Development Department to bring the zoning map for the Town of Oregon into <br /> compliance with the requirements of subch. V of ch. 91, Wis. Stats. On November 21, 1996, <br /> the Dane County Board of Supervisors adopted a revised zoning map ("new zoning map") for <br /> the Town of Oregon, which substantially meets these statutory requirements. <br /> Staff Review <br /> The major issue that had to be resolved in developing the "new zoning map" was the number <br /> of inconsistencies between the agricultural preservation plan map and the exclusive agricultural <br /> districts of the zoning ordinance map. <br /> Based on the meetings between department staff and the county staff, the new zoning map <br /> amendment submitted for certification changes significant areas from A-1 (exclusive) zoning to <br /> A-3 (transition) zoning to bring them into conformance with their plan designation as Ag- <br /> Transition. This will remedy the largest part of the inconsistencies between the plan and zoning <br /> ordinance maps that affect certification. The remaining inconsistencies fall primarily into two <br /> classes: (i) a small number of inconsistent parcels designated as rural development on the plan <br /> amendment map, but currently zoned for A-1 or A-3 (about 800 acres); and (ii) a small number <br /> of parcels designated as being in agricultural preservation on the plan amendment map, while <br /> being zoned A-3 Ag-Transition on the zoning map amendment, or being in agricultural transition <br /> on the plan map, while being zoned as A-1 Ag-Exclusive on the zoning map amendment (about <br /> 400 acres). Class (ii) inconsistencies do not involve the possibility of ineligible parcels <br /> 1 <br />
