DANE COUNTY ORDINANCE AMENDMENT NO. 6795 Amending Section 10.03 relating to Zoning Districts in the Town of Oregon. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Oregon be amended to include in the A-2(1) Agricultural and C-2 Commercial District/s the following described land: PETITION NUMBER: 6795 TO C-2: - PARCEL `A': A part of Lot #1, CSM #4294, Town of Oregon, described as follows: Beginning at the Northeast corner of said Lot #1, CSM #4294; thence N 89° 12' 26" West, 299.71 feet; thence S 10° 29' 14" West, 188.00 feet; thence S 89° 12' 26" East, 312.05 to a point on a curve; thence along the arc of a curve concaved Northwesterly having a radius of 11,409.2 feet and a long chord bearing N 06° 44' 37" East a distance of 186.32 feet to the point of beginning.- TO A-2(1): - PARCEL `B': A part of Lot #1, CSM #4294, Town of Oregon, described as follows: Beginning at the Southeast corner of said Lot #1, CSM #4294; thence N 89° 12' 26" West, 323.20 feet; thence N 10° 29' 14" East, 236.00 feet; thence S 89° 12' 26" East, 312.05 feet to a point on a curve; thence along the arc of a curve concaved Northwesterly having a radius of 11,409.20 feet and a long chord bearing S 07° 48' 00" West a distance 234.38 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. The building size on the C-2 rezone area shall not exceed more than one-third of the parcel size. 2. The petitioner shall be allowed to park only licensed vehicles outside of the building, shall not be allowed to store any equipment outside of the building, and shall not be allowed to s ore any tires, etc. outside of the building. 3. Operation will be limited to assembly and repair of automobile chassis parts and to onsistent with the Town of Oregon groundwater protection requirementi will n t allow any use of oils, lubricants, paint, or other potential contaminants, for commercial use. o i 4. The operation will allow for the repair and sales of aut o ' e chassis and related items, not to exceed three employees, one sign on property, and welding by the applicant. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void.
