The Zoning Division discovered the off-premise sign during a review <br /> for a zoning map amendment for the property. Upon investigation, it was observed that a <br /> 12' x 22' off-premise advertising sign was constructed on the property fronting US <br /> Highway 14. Historic aerial photography shows that the sign was placed on the property <br /> sometime around 2005. The sign is located approximately 200 feet away from an <br /> existing legal off-premise advertising sign located on an adjacent lot. In checking Zoning <br /> Division records, no permit was issued for this sign. The Department of Transportation <br /> Outdoor Advertising does not have records of this sign either. <br /> Under Dane County Code of Ordinance section 10.74(6), billboard signs (off-premise <br /> advertising) shall be located a minimum of 300 feet away from each other. <br /> Under Dane County Code of Ordinances (DCCO), Chapter 10, Zoning Regulations, <br /> section 10.91, a zoning permit is required to be obtained prior to the construction of a <br /> sign to ensure compliance with zoning regulations. The purpose of this regulation is to <br /> ensure public safety, preservation of scenic beauty, and the implementation of the desired <br /> overall character of the community and constituent zoning districts. Failure to obtain a <br /> permit for the construction of a sign is a violation of DCCO 10.91. <br /> This letter serves as notice that the construction of the billboard sign located on the <br /> property at 1222 US Highway 14, as identified as Parcel# 0510-072-9950-6, is in <br /> violation of the Dane County Code of Ordinances, Zoning Regulation, sections 10.74(6) <br /> and 10.91. You are hereby instructed to remove the sign within 10 days of the date of <br /> this letter or be subject to penalties as noted in DCCO 10.92. If the sign is not removed <br /> within the specified timeframe, compliance shall be sought through circuit court action. <br />
