DANE COUNTY ORDINANCE AMENDMENT NO. 6822 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Dunkirk. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Dunkirk be amended to include in the RH-3 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 6822 <br /> Part of the NE 1/4 of Section 36, Town of Dunkirk described as follows: Commencing at <br /> the North quarter corner; thence East along the North line of said NE 1/4, 1317.6 feet to <br /> the point of beginning; thence continue East, 250 feet; thence S 45°West, 350 feet; thence <br /> South, 1650 feet; thence West, 726 feet; thence North, 594 feet; thence East along the <br /> South line of the NW 1/4 NE 1/4, 660 feet; thence North, along the East line of said NW <br /> 1/4 NE 1/4, 1325. 4 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. To specify that except for the first 250 feet south of CTH N,the driveway is to be kept 10 feet east of the <br /> West lot line and the driveway is not to exceed one rod in width and not more than 3/4 of an acre of <br /> woods shall be clear cut for construction with the balance of the wood land to be kept in a natural wooded <br /> state. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> Effective: 3 / (37 / 97 <br />
