REGARDING ZONING PETITION #6830 - ATTACHED SHEET 12B <br /> February 19, 1997 <br /> Attachment to Town Board Action Report <br /> Regarding zoning petition 6830 <br /> Plan Commission Minority Report <br /> A vote to disapprove zoning petition #6830 was cast for the three following <br /> reasons: <br /> 1. The rezone request is inconsistent with the Town of Blooming Grove Land <br /> Use Plan. (Please see the RPC staff comments sheet dated February 10, 1997 <br /> and supplemental comments dated February 19, 1997 for details.) <br /> a. The proposed C-2 development is on prime farmland in the AG-1 EX district. <br /> b. The road to the residental parcel would appear to cross agricultural land. <br /> c. The proposed expansion of the existing limited family business would <br /> constitute a strip commercial development which is required to be in the <br /> urban service area and not on a minor arterial such as Hwy AB. <br /> 2. The petitioner did not present sufficient justification for the rezone <br /> request. <br /> a. no rationale for the expansion of the facilities of the existing limited <br /> family business was presented to the plan commission. <br /> b. petitioner was inconsistent on the "future home" reason for the A-2 rezone <br /> request. In fact, the petitioner retracted the future-home-for-son reason for <br /> the request. <br /> The petitioner stated in an undated, written document, received Jan. 30, 1997 at <br /> Dane County Planning, that the rezone was requested "so that I can build a <br /> home for my son in the future". The petitioner retracted that reason in a <br /> statement to the BG plan commission on the evening of 02/19/97. She said, <br /> quote "The house doesn't matter. The house isn't a reason." The petitioner <br /> went on to state that the reason she wanted the land rezoned to A-2 is "because <br /> it's not farmland" and that she wants it to be the same as her other land with <br /> an A-2 zoning. <br /> These seem like dubious and insufficient reasons on which to base an <br /> approval to rezone. Can someone receive a rezone out of AG-1 EX--or any <br /> other zoning classification--just because they want to and think it's a good <br /> idea? <br /> 3. The plan commission's decision seems to hinge on three points (see Town <br /> Board Action Report, reasons for approval despite non-compliance with town <br /> land use plan) : 1)whether one believes the property in question is truly <br /> prime farmland or not; 2) invalid initial AG-1 Ex zoning classification; and 3) <br /> present owner does not farm this land because of poor yield. <br /> No evidence, let alone proof, was offered in support of any of these three <br /> opin;j s. <br /> Steve Glass <br /> Chair, Blooming Grove Plan Commission <br />
