All town <br /> conditions, through both its recommendation on the CUP and approval of a non-metallic mining <br /> permit, have been included (see conditions 7, 10, 16) or are enforceable under the zoning <br /> ordinance. Staff and the applicant appear to be in general agreement on appropriate conditions, <br /> but the applicant may wish to speak to one or more specific conditions suggested below. <br /> After making findings regarding the general standards for granting a CUP (Section 10.255(2)(h)) <br /> and specific considerations for CUPs in the A-1 Exclusive District (Section 10.123(3)(a)), the <br /> Committee may consider the following conditions: <br /> 1. The applicant shall submit an erosion control plan covering the entire CUP area for the <br /> duration of operations, and receive approval of an erosion control permit prior to <br /> commencing extraction operations. <br /> 2. The applicant shall apply for and receive a special exception permit for any lands proposed <br /> for excavation which are within the shoreland area as designated in Chapter 11, Dane County <br /> Ordinances, and a flood zone permit for any lands proposed for excavation which are within <br /> the floodplain area as designated by FEMA floodplain maps. The applicant may begin <br /> operations on lands outside the shoreland and floodplain areas before receipt of such permits. <br /> 3. The applicant shall apply for and receive all other required local, state and federal permits, <br /> including but not limited to a zoning permit from the Zoning Division. <br /> 4. Operations shall cease no later than eight years from the date of CUP approval. <br /> 5. Reclamation shall be completed within one year after operations have ceased, and shall follow <br /> the applicant's submitted"Restoration Plan" and "Reclamation Summary." The operator <br /> shall post and maintain at all times during the term of the CUP a bond in favor of the County <br /> in the amount of$25,000 payable to Dane County to ensure compliance with the reclamation <br /> plan. <br /> 6. The excavation area shall be enclosed with a woven wire fence aligned as shown on the <br /> submitted "Site Initiation Plan." The fence shall have one strand of barbed wire on the top, <br /> with a total height of not less than five feet. The haul road and any other access points shall <br /> have gates securely locked when the extraction site is not in operation. The site shall be <br /> signed "no trespassing." <br /> 7. The gravel drive immediately east of the 2494 Nora Road property shall be removed. <br />
