The applicant may <br /> begin operations on lands outside the shoreland and floodplain areas before receipt of such <br /> permits. <br /> 3. The applicant shall apply for and receive all other required local, state and federal permits, <br /> including but not limited to a zoning permit from the Zoning Division. <br /> 4. Operations shall cease no later than eight years from the date of CUP approval. <br /> 5. Reclamation shall be completed within one year after operations have ceased, and shall <br /> follow the applicant's submitted "Restoration Plan"and "Reclamation Summary." The <br /> operator shall post and maintain at all times during the term of the CUP a bond in favor of <br /> the County in the amount of$25,000 payable to Dane County to ensure compliance with the <br /> reclamation plan. <br /> 6. The excavation area shall be enclosed with a woven wire fence aligned as shown on the <br /> submitted "Site Initiation Plan." The fence shall have one strand of barbed wire on the top, <br /> with a total height of not less than five feet. The haul road and any other access points shall <br /> have gates securely locked when the extraction site is not in operation. The site shall be <br /> signed"no trespassing." <br /> 7. The gravel drive immediately east of the 2494 Nora Road property shall be removed. <br /> 8. The operator shall create and maintain throughout the term of the CUP a landscaped earthen <br /> berm, not less than 12 feet in height, located south of the extraction operation as delineated <br /> on the"Site Initiation Plan." The berm shall be seeded. <br /> 9. The operator shall pave with asphalt the haul road (driveway) as shown on the"Site <br /> Initiation Plan," and shall maintain the haul road in a dust free manner in accordance with <br /> local, state, and federal regulations. <br /> 10. Hours of operation, except for crushing, shall be from 6:00 a.m. to 5:00 p.m., Monday <br /> through Friday, and from 8:00 a.m. to 1:00 p.m. on Saturdays. Crushing shall not occur <br /> before 8:00 a.m. on any day. No operations of any kind shall take place on Sundays or legal <br /> holidays. Hours of operation may be temporarily extended for special circumstances, but <br /> only after approval by the Town Board. <br /> 11. There shall be no blasting or drilling on the site. <br /> 12. The operator shall use spray bars (water) in the crushing process to reduce dust. Use of <br /> spray bars is not required when the temperature is below freezing. The operator shall spray <br /> the site with water if and when needed to control dust. <br /> 13. There shall be no bulk fuel stored on site. All excavation equipment,plants, and vehicles <br /> shall be fueled, stored, serviced, and repaired on lands above 860 feet in elevation to prevent <br /> against groundwater contamination from leaks or spills. <br /> 14. No water shall be pumped or otherwise removed from the site in order to maintain <br /> groundwater discharge to adjacent wetlands. <br /> 15. The operator shall require all trucks to have muffler systems which meet or exceed then <br /> current industry standards for noise abatement, and shall require all excavation and crushing <br /> equipment to meet or exceed the then more current industry standards for noise abatement. <br /> 16. The operator shall repair any damage to Nora Road resulting from the mineral extraction <br /> operation. <br />
