COMPOSITE REPORT-Page 2 Application Rezoning 6857 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> I. BACKGROUND <br /> A. The Applicant owns four parcels in the town of Blue Mounds. All parcels are zoned A-1 Ex and less than <br /> 35 acres in size. They are located in three areas: two adjacent parcels south of USH 78, one 1.94 acres parcel <br /> north of the intersection of USH 18 & 151 and one 1.63 acres parcel south of the same intersection. <br /> B. The applicant has asked to place the four parcels into 4 rezonings, following the tax parcel boundaries. <br /> The two parcels next to the intersection of USH 18 &151 would be changed to A-2 (1) . The area along USH 78 <br /> would to be divided into two areas: the parcel adjacent to the Highway would be changed to A-2 (4)and the rear <br /> parcel to A-2. <br /> C. The two parcels along the intersection of USH 18 &151 present difficult locations. The one on the north <br /> side is between the Limited Access Highway and the DNR bike path. The DNR limits the access just to serve <br /> agricultural uses since it must cross the bike path to get to STH 78. The parcel has been farmed by a leasee <br /> along with the adjacent land to the west. The other parcel on the south side of the intersection is a triangular <br /> piece cut up by State Highway purchase and is a relatively poor land for farming. Access can be obtained <br /> through a purchase of an easement. The two parcels further south on USH 78 have access frontage when <br /> considered jointly. <br /> D. The Access arrangements need to be worked out for the triangular parcel. The Town has approved all four <br /> rezonings. <br /> II. ANALYSIS <br /> A. The RPC staff comments indicate that all parcels are in an agricultural preservation area of the Town.As <br /> also noted in the RPC comments,the more controlling feature is the need to be in compliance with the zoning <br /> ordinance where the minimum size for A-1 Ex is 35 acres. None of these zoning parcels is as large as 35 acres. <br /> A rezoning would appear appropriate as it would put the area into compliance with the zoning regulations. <br /> B. The site appears to have no particular environmental issues. The area on the north side of USH 18 & 151 <br /> is in the Mt. Horeb Urban Service Area but is not currently served by sewer as indicated in the RPC staff report. <br /> C. The main issue is the desirability of having the potential for residential development on any of the parcels <br /> in question. All four of the rezoning districts indicated in this application follow the requirements for a single <br /> family home. The triangular parcel to the south of USH 18-151 meets the legal road frontage requirement by <br /> abutting to USH 18 & 151,but does not have practical access at this point. Access for both parcels next to <br /> USH 18 & 151 can be obtained if only used for agriculture. <br /> D. The Town has indicated in previous discussions concerning the area that there is some interest for <br /> commercial use in this area. The Town is aware that the current Town Plan does not call for commercial <br /> development. In the recent past the WisDOT has also completed the rezone of a property adjacent to the present <br /> property. These rezonings were deed restricted to prohibit residential development. <br /> E. The issue that may present some confusion is the two districts of the adjacent parcels on USH 78. The <br /> Applicant appears to have no particular desire to have two zoning in this area since no division is contemplated. <br /> The proposed rezoning follows the existing tax property line. <br /> III CONCLUSIONS <br /> A. For access reasons and long term use, it may be desirable to have a Restrictive Covenant prohibiting <br /> residential development on all of the parcels involved in he rezoning. <br /> B. It may be desirable to have the two parcels next to USH 78 treated as an entire area zoned A-2 and delete the <br /> A-2(4)district. The A-2 area next to USH 78 would total just over 30 acres. <br />
