Box 371 <br /> Cambridge, WI 53523 <br /> Dear Cyndi and Gerhard: <br /> As you know, the question of whether or not you reside in the School District of <br /> Cambridge for education purposes, has been questioned by people in the community and <br /> by the School Board. At the October 28 School Board meeting, the School Board <br /> requested that I further investigate the situation. I decided to involve our school attorney, <br /> Jim Ruhly of Melli, Walker, Pease and Ruhly to get their opinion. This decision was <br /> made because I felt I needed an independent legal opinion as to what constituted a <br /> residence, and to see how they felt your situation measured up to that opinion. I shared <br /> many documents with them, including your letter of October 11, 1996, in which you <br /> stated: "Our home at 3028 Fadness Road is in the Cambridge School District. We pay <br /> property taxes to the district that our children have and will continue to sleep in the district <br /> and this is in compliance with state laws". <br /> The conclusion of attorney, Dana J. Erlander of the previously mentioned law firm is that <br /> the Wisconsin courts would probably hold that your arrangement of sleeping in a trailer <br /> three nights per week does not constitute residency. Their reasoning is as follows: <br /> 1. A person can only have one residence. <br /> 2. Children are only entitled to free tuition if they actually reside in a school <br /> district for a primary purpose other than participating in the advantage which <br /> the school affords. <br /> 3. None of the family appear to be residing in the trailer on a full time basis. <br /> 4. The purpose of one parent and the children sleeping in the Cambridge <br /> district three nights per week is not because the Banfi's prefer the trailer, <br /> need to comply with a court order, or need to accommodate the new <br /> residence of a parent. The admitted purpose of this partial residence <br /> arrangement is solely to qualify for educational benefits. <br />
