It follows that administration of <br /> conditional use permit provisions in this case is by the Village of DeForest. <br /> I note further that the language of sec. 62.23(7a)(g), Stats., provides that "The <br /> governing body of a city which adopts an extraterritorial zoning ordinance under this <br /> subsection may specifically provide in the ordinance for the enforcement and <br /> administration of this subsection." The Village of DeForest has expressly reserved this <br /> authority in its enactment of extraterritorial powers. <br /> For the above reasons, it is my opinion that the any further proceedings on <br /> conditional use permit no. 1237 must be conducted by the Village of DeForest. <br /> Sincerely, <br /> Cal W.
