Phelp <br /> Dane County Execut v= <br /> SUBJECT: Veto of Zoning Petition #6305 <br /> I am vetoing Zoning Petition #6305 because it violates the 35 acre <br /> density requirement as that policy is stated in the Town of <br /> Springfield Land Use Plan. <br /> Petition #6305 would permit the division of a 10 acre parcel, in <br /> Springfield's Agricultural Preservation Area and currently zoned A- <br /> 1 Agricultural Exclusive, into 2 lots, zoned RH-2 Rural Home, for <br /> residential development. <br /> The Town of Springfield Land Use Plan contains a simple, clear <br /> version of the 35 acre density requirement. It does not provide <br /> for exceptions, nor does it provide for the division of non- <br /> conforming parcels in the Agricultural Preservation Area. This <br /> proposed division, which concerns a non-conforming parcel, violates <br /> the 35 acre density policy. Even if one adopted a lenient <br /> interpretation of this policy as it pertains to this parcel and the <br /> buyers' other parcels, the proposed division violates the policy. <br /> As all of you recall, the Town of Springfield recently revised its <br /> Land Use Plan after a long, complex, and arduous discussion. One <br /> result of that discussion was that the Town decided to keep the 35 <br /> acre density requirement as an important part of its effort to <br /> maintain the Agricultural Preservation Area. And the Town's plan <br /> continues to be part of the County Land Use Plan, which I have the <br /> responsibility to uphold. Moreover, I have indicated that the 35 <br /> acre density policy is one of the standards that I will use in <br /> approving or vetoing residential development petitions in the <br /> County's Agricultural Preservation Areas.
