DANE COUNTY ORDINANCE AMENDMENT NO. 6329 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Westport <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Westport be amended to include <br /> in the A-B Agricultural Business District/s the following described land: <br /> yet. #6329: <br /> Part of the NE 1/4 NE 1/4 and SE 1/4 NE 1/4 Section 10, Town of <br /> Westport described as follows : Commencing at the Northeast corner of <br /> said Section 10; thence S 00° 03 ' 03" West along the East line of <br /> said Section 10, 98 . 52 feet to a point on the Southerly right-of-way of <br /> STH 19 and the point of beginning of this description. Thence continues <br /> S 00° 03 ' 03" West along said East line 1890.79 feet; thence S 88° 42 ' <br /> 09" West, 430. 06 feet; thence N 00° 03 ' 03" East, 1914 . 91 feet to a <br /> point on the Southerly right-of-way of STH 19; thence N 89° 55' 00" <br /> East along said Southerly right-of-way 180 . 92 feet; thence continuing <br /> along said Southerly right-of-way S 86° 38 ' 08" East, 249. 44 feet to <br /> the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3) <br /> (a) 2 . (b) of the Dane County Code of Ordinances . The rezoned area <br /> shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> That only the following uses shall be allowed and other conditions <br /> as applied to said parcel: <br /> 1 . Indoor retail . <br /> 2 . Landscape business. <br /> 3 . Outdoor retail, craft shows, to be limited to 12 shows per year, <br /> April through November. <br /> 4 . Locations and uses as specified on Exhibit "A" which is the <br /> conceptual plan for Sparby' s Christmas Barn and Santa' s Park. <br /> Said restrictions shall run in favor of Dane County and the pertinent <br /> Town Board as well as the owners of land within 300 feet of the site. <br /> Failure to record the restrictions will cause the rezone to be null <br /> and void. <br /> EFFECTIVE DATE: <br />
