COMPOSITE REPORT: PET.#9551/CUP#2022 AGENDA ITEM#18 <br /> JULY 25,2006 ZLR COMMITTEE PUBLIC HEARING <br /> CHRISTIANA 27,A-1EX TO A-2(1)WITH CONDITIONAL USE PERMIT FOR DEPENDENCY LIVING <br /> ARRANGEMENT <br /> DANE COUNTY ZONING STAFF COMMENTS/BACKGROUND <br /> • Owner(s)of record: Michael& Virginia Bartman <br /> • Size,zoning, use of existing parcel: 1.2 acre existing legal non-conforming A-1Exparcel includes the <br /> Bartmans' house, detached garage(to be removed), and a chicken coop. <br /> • Rezone/CUP desired: Rezone to A-2(1)district which allows CUP for a Dependency Living Arrangement. <br /> • The Bartmans wish to provde living space for"parents and family members." They would build a <br /> 30'x40'+- addition with 27'x29'+- attached garage(to replace the existing detached garage. The <br /> addition would have a basement for storage and utilities and a first floor living room/kitchen area, <br /> separate bedroom and bath with laundry facilities(no second floor). <br /> • The floor plans submitted show an entrance alcove with separate doors to the existing home and new <br /> "dependency' living unit. The basement floor plan shows an opening between the existing basement <br /> and the added basement and stairs from the new basement to the new garage. <br /> • See Zoning Issues. <br /> • Number of new home sites created: No new home sites—one existing home with secondary living unit. <br /> • Soils/Uses: A-1EX NC'g <br /> • Shoreland/Floodzone/Wetlands:None <br /> • Zoning Issues: A Dependency Living Unit is defined as"...a physical arrangement of a dwelling unit in <br /> such a fashion that separate living spaces are created within a dwelling unit for the sole purpose of allowing <br /> a dependent person to live in the secondary unit while the owner and his or her family reside in the principle <br /> living area. The secondary living unit may contain a bath and limited kitchen facilities which permit a <br /> degree of independence."(Section 10.01(19a) DCCO.) The Bartmans' application for a CUP for <br /> Dependency Living Arrangement does not address the `dependency' provision of the definition. <br /> DANE COUNTY AGENCY COMMENTS <br /> The following agencies are reviewing the petition and may submit comments prior to or after the Zoning and <br /> Land Regulation Committee Public Hearing. <br /> Land Conservation(Questions?
