7 : 05 P.M. <br /> July 31, 1995 <br /> A SPECIAL meeting of the Verona Town Board was held Monday, July <br /> 31, at the Verona Town Hall to consider rescinding a condition <br /> (Timber Lane Driveway access for B.Avedon lot) on zoning petition <br /> #6195 approved earlier by Town and Dane Co. The meeting was <br /> called at the request of John Kassner, atty. for R. Eberle . <br /> PRESENT: Dahlk, Beauchamp, Bitzer, Tollefson, Enburg & Johnson <br /> ALSO PRESENT: Attys . Bruce Kaufman, John Kassner .& A , Mr. & i_ . <br /> Mrs .Raemisch, Richard Eberle, Burt/Sylvana Avedon>Loren Paulson .:' "" ' <br /> John Kassner reported the decision of the county Board' of <br /> Adjustment to deny a special exception permit, and summarized the <br /> reasons given for the decision. He stated his intent to submit a <br /> new zoning petition to remove the condition requiring a Timber <br /> Lane access, but would like to have approval of this from the <br /> Town before county submittal . He also stated that his client may <br /> have to sue the board of adjustment . In response to questions <br /> regarding access, he said the intent was to provide for this by <br /> deed and easements : Mr. Eberle would deed Outlot #1 (Coray Lane <br /> plat) to Mr. Avedon, who would give an access easement to Mr. & <br /> Mrs . Raemisch, and also to Mr. Eberle for the second lot in CSM # <br /> ? providing Springdale in the future allows more than two homes <br /> on a shared drive with one road access . <br /> Board reaffirmed its reasons (municipal services, ie . , fire, EMS, <br /> schools) for insisting that access be on Timberlane not Coray. <br /> Bitzer pointed out that the engineering plans presented had <br /> apparently been satisfactory to the Board of Adjustment, and that <br /> its decision was contrary to what all the other public bodies <br /> (ie . , town plan commission and town board, county zoning <br /> committee and county board, and ultimately the county executive) <br /> had approved. Enburg asked if Eberle could provide the governing <br /> bodies with a plan for the whole farm, which would serve notice <br /> to prospective property owners of the developer' s future intent . <br /> Atty. Kaufman indicated easements were to be questioned and <br /> access from Coray Lane was not an option as his clients <br /> (Raemischs) would oppose any change; he requested notice of any <br /> future meetings at which this subject would be discussed. <br /> Eberle and Atty. Kassner were informed that no decision on <br /> reversal of previous condition would be forthcoming by the Board <br /> at this time, because nothing has yet been submitted and referred <br /> to the town by Dane County. Should a new zoning petition be <br /> filed; the Town would insist on a new certified survey map, with <br /> all private drives, easements, strips abutting public roads, <br /> proposed accesses and ownership of such, be shown on the face of <br /> the document prior to final approval . Moved by Bitzer, seconded <br /> by Beauchamp, to adjourn the special meeting. Motion Carried. <br /> Rose M. Johnson, Clerk/Treas . <br />
