Dane County may review the adequacy of the bond amount every five years. If, as a result of <br /> increases in the cost of labor and/or materials for general construction, the bond amount <br /> appears inadequate to the Town or Dane County, operator shall post and maintain such <br /> increased bond in favor of the Town and Dane County within 30 days after the Town's or <br /> Dane County's request to the operator. <br /> The reclaimed area shall be graded so as not to have slopes greater than twelve (12) <br /> percent. <br /> Operator may import material necessary to comply with the approved reclamation plan <br /> but shall not import contaminated materials to do so. <br /> 6. Permits and Environmental Compliance. Operators shall secure and maintain <br /> in full force and effect prior to commencement of quarry operations all permits from federal, <br /> State and local authorities-tkecessary to open and operate the quarry. <br /> 7. 6nsurance. /Operator will secure and maintain in full force and effect during <br /> L,� the term of this-Agreement, public liability insurance in the amount <br /> ($10,000,000.00) naming the Town and Dane County as additional insureds asltheirr interests <br /> may appear. <br /> 8. Perimeter Fencing. Operators shall maintain a woven wire fence near the <br /> perimeter of the Property. This fence will have an overall height of five (5) feet with one <br /> strand of barbed wire at the top. The quarry shall be posted "NO TRESPASSING OR <br /> HUNTING". The haul road shall have a gate securely locked when the quarry is not in <br /> operation, and the Operator shall install a suitable gate. <br /> 9. Enforcement. The Town and Dane County shall have the right to enforce this <br /> Agreement by the commencement of an action in the Dane County Circuit Court. Prior to <br /> commencing such action, the Town or County Board agrees to give Operator fifteen (15) <br /> days' advance written notice of any alleged default under this Agreement and the Operator <br /> shall have the right to cure such alleged default within fifteen (15) day period, or within such <br /> other periods of time as the parties may mutually agree. Substantial efforts by Operator which <br /> will result in a total cure within a reasonably foreseeable period of time shall be deemed a <br /> cure for purposes of this section 9. If the alleged default is not cured, the parties agree that <br /> the Town or County Board will be entitled to seek such equitable or other relief as it may <br /> deem appropriate, including, but not limited to, its actual costs and attorney's fees. This <br /> section is solely for the benefit of the parties to this Agreement. <br /> 10. Right of Inspection. The Town Board shall have the right to periodically <br /> inspect the Property during normal business hours upon reasonable advance notice to <br /> Operator. Such inspection will not disrupt Quarry operations and all safety procedures <br /> specified by Operator shall be observed by the Town Board during the inspection.. A <br /> representative of the Operator must be present during any such inspection. <br /> 6 <br />
