DANE COUNTY ZONING BOARD <br /> In Re: Dane County Zoning Board RESPONSE TO TOWN <br /> Howard Lien & Sons BOARD'S RECOMMENDATIONS <br /> Conditional Use Permit <br /> Application No. 1262 <br /> The Conditional Use Permit was referred by the Dane County <br /> Zoning Board to the Town of Christiana. The referral was made <br /> under Section 10.255 (2) (c) of the Dane County Zoning Ordinances. <br /> Under the Zoning Ordinance, the Town Board was given the right to <br /> review the Conditional Use Application, make a finding of <br /> consistency or inconsistency with the Town Land Use Plan and make <br /> suggested conditions for any permit which it may recommend <br /> granting. The recommendations and finding of the Town will be <br /> advisory to the Committee. <br /> The Town Board made no finding of inconsistency of the <br /> proposed Conditional Use Permit with the Town Land Use Plan. In <br /> fact, there is none. The Town Board was not opposed to the <br /> granting of the permit but proposed a number of suggested <br /> conditions for the granting of the permit. These suggested <br /> conditions are advisory to the Dane County Zoning Board. It is the <br /> purpose of this Memorandum to set forth the Petitioner's reactions <br /> and concerns as to the Town Board's proposed conditions: <br /> 1. Area I 4th Phase of Map: (pink, left middle) No CUP <br /> approval due to size of deposit and easement of the power <br /> line. <br /> 2. Area II 1st phase of Map: (orange) CUP approved area <br /> subject to conditions. The area is from the westerly <br /> edge of the east power line easement to the easterly edge <br /> of the west power line easement. <br />
