Ate_, # <br /> Page 1 <br /> TOWN BOARD ACTION REPORT <br /> REGARDING ZONING PETITION _6396 PUBLIC IFA.RING _10/10/95 <br /> Whereas , the Town Board of the Town of RUTLAND <br /> having considered said zoning petition , be it therefore resolved that <br /> said petition is hereby (Approved) . <br /> SUBJECT TO THE FOLLOWING CONDITIONS: <br /> (Cross out or write "none" if you do not wish to pi <,ce any conditions) <br /> This petition was conditionally approved cun_tirs ent upon the R-IA <br /> parcel having a deed restriction limiting it t.0 di single liortit_ c'. dr.d <br /> the remaining land be approved as RH-4 instead oL A-2 based , i the <br /> transfer of the development rights from Douglas Olson to Evelyn <br /> Handeland . <br /> PLEASE NOTE: If the proposed rezoning is approved by the Town Board , <br /> but said rezone does not comply with the Town Land Use Plan , please <br /> list the reasons for the approval . These reasons can be a critical <br /> factor for both the Zoning Committee and the County Board in their <br /> consideration of the rezone. <br /> The property was viewed in January 1995 by the Planning Commission . It <br /> was found that the Handelands had sold approximately 100 acres of their <br /> 120 acre farm to Douglas Olson in 1980 , leaving them only 20 acres . <br /> The Town of Rutland Land Use Plan, instituted in 1978 , would have <br /> allowed the creation of two building parcels on this 100 acre farm. <br /> Mr. Olson is willing to assign his development rights for a building <br /> site back to the Handelands (see attached statement) . The land that <br /> Olson purchased from the Handelands ' is very good farmland whereas the <br /> :j parcel that the new home would be sited on is Grace #3 and would he <br /> taken off the remaining Handeland property . Because the primary <br /> I purpose of the Land Use Plan is to preserve prime farmland, it is the <br /> Town ' s intent to make an exception in this case, and not to approve as <br /> standard policy. j <br /> I , Dawn George , as Town Clerk of the Town of Rutland , County of L: - .
