I recognized that perhaps I had just experienced an <br /> historical deja-vu of an ancient borough whose feudal customs were zealously protected <br /> through a modern contrivance called a "land use plan." Regardless of my personal <br /> quest, I had to admit a slight wry admiration for a modern day tactic requiring ancestral <br /> relationships, or limiting the opportunity for increasing property value only to a progeny <br /> connection as a method for "curbing urban sprawl." At this moment I thought that <br /> anyone whose genius had a topographical as well as a genetical bent would probably <br /> know perfectly well that the Town of Christiana in Dicken's words was a "corporate <br /> town" whose chairman, board councils, and planning commissioners all had perhaps <br /> similar addresses if not the same grandmother. <br /> On the premise that one should continue our forefather's revolution to free <br /> oneself from seemingly feudal and unfair land policies, I proceeded to acquire an <br /> undated copy (attached hereto) of the Town's "Land Use Plan" and discovered that the <br /> reasons given by Town Chairman Lien were not a published part of the plan. I also <br /> briefly reviewed some of the Town's past zoning activities and found that "precedence" <br /> was a key dynamic and implementer for making their land use plan a living organism, so <br /> to speak, as it could be changed at any time. Parenthetically, precedence could also be <br /> used for challenging the Town and Town Chairman Lien's unpublished "ancestoral and <br /> progeny" rationale for restricting zoning based on not meeting that criteria. Overall, my <br /> assessment of the Town's "Land use Plan" is that it is a non-conforming plan and allows <br /> carte blanche for any kind of decision to be made by the Town's Planning Commission <br /> and Board regardless. <br /> On the basis of the above, I decided to request approval from the County Zoning <br /> Committee and Board for my zoning request, understanding that your decision is not the <br /> final verdict on this particular case. <br /> Thank you. <br /> CC: Town of Christiana Chairman Stanley Lien <br /> Board members David Smithback <br /> Kenneth Stach <br /> Town Planning Commissioner <br /> Chairman Lars Lien and Commissioners <br />
