PLANNING & DEVELOPMENT 210 Martin Luther King Jr. Blvd. ZONING DIVISION Madison, WI 53709 RE: Application for Rezoning Submitted by Donald Lehnherr Zoning Petition#6408 Dear Sir or Madam: Regarding the above, please note that I represent Richard O. Jacobson and Karen Johnson, who are named vendors in a land contract with Donald Lehnherr and Lorraine Lehnherr as purchasers. The contract is still valid, and will continue to August of 1996. Given the language in the land contract, which requires the Lehnherrs to obtain approval by the vendors of the sale of the land, I inform the zoning department that this approval has not been given by my clients. In fact, Mr. and Mrs. Lehnherr have not been in touch with my clients or with me. It is my understanding that Mr. and Mrs. Lehnherr are making application for this zoning change pursuant to an offer to purchase which they have entered into affecting a portion of the premises which are subject to the land contract. I inform the committee that, at this point, it is unclear whether this sale will take place. Until the Lehnherrs contact my clients to discuss this sale, my clients are unwilling to approve the transfer of land under the offer to purchase, and therefore, without this lack of approval, it is possible that the sale will not take place. At this point, and on behalf of Richard Jacobson and Karen Johnson, I register disapproval for this zoning change. If, in fact, the Lehnherrs are able to make arrangements with the vendors prior to the hearing in this matter scheduled for October 10, 1995, I will so inform. Thank you.
