The State Statutes, pursuant to 59. 97 (5) (e) prescribe <br /> the process by which zoning classifications must be changed. This <br /> process requires the following: <br /> 1. A petition to change zoning being submitted to the County <br /> Clerk. <br /> 2 . County Clerk referral to the zoning agency (Zoning & <br /> Natural Resources Committee) . <br /> 3 . Notice to the county supervisor in the affected district. <br /> 4 . Report to county board of all petitions submitted. <br /> 5. Public hearing by the zoning agency. <br /> 6 . Action by the pertinent town board. <br /> 7 . Report of zoning agency action to the county board. <br /> 8 . Action by the county board. <br /> 9 . Action by county executive. <br /> The above listed process is the only method by which a zoning <br /> classification may be changed, any other method would not be legal. <br /> If there is a desire to require a zoning classification to revert <br /> back to a prior classification or, change to a different preferred <br /> classification, you might consider using a contract agreement <br /> between the town and the property owner. Said contract could <br /> specify that, upon a designated occurrence such as a cessation of <br /> a business or transfer of land ownership, an application shall be <br /> made to change the zoning classification back to the prior zoning <br />' or whatever zoning might be preferred by the town board.
