S. DANE COUNTY ORDINANCE AMENDMENT NO. 6101 Amending Section 10. 03 relating to Zoning Districts in the Town of Dunn The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Dunn be amended to include in the R-4 Residential District/s the following described land: Part of the SE 1/4 SE 1/4 Section 26, Town of Dunn described as follows: Commencing at the Southeast corner of Section 26, Town of Dunn; thence N 00° 15 ' 19" West 166. 65 feet to the point of beginning. Thence S 89° 07 ' 03" West 190. 00 feet; thence N 00° 15 ' 19" West 240. 00 feet; thence N 89° 07 ' 03" East 190. 00 feet; thence N 00° 15 ' 19" West 240. 00 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10. 255 (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: (A) Residential use of the property shall be limited to no more than a triplex. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. A copy of the recorded document - - - Dane County Zoning. CO P ION: 1. - The rezone shall be effective upon the execution of an agreement with the Town of Dunn which specifies that the property owners, Juliun R. Atkinson and/or Agnes H. Atkinson, their heirs, assigns or representatives, will make application to rezone the property to single family or duplex zoning at such time they no longer reside on the property.
