S. <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6101 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Dunn <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Dunn be amended to include <br /> in the R-4 Residential District/s the following described land: <br /> Part of the SE 1/4 SE 1/4 Section 26, Town of Dunn described as <br /> follows: Commencing at the Southeast corner of Section 26, Town of <br /> Dunn; thence N 00° 15 ' 19" West 166. 65 feet to the point of <br /> beginning. Thence S 89° 07 ' 03" West 190. 00 feet; thence N 00° 15 ' <br /> 19" West 240. 00 feet; thence N 89° 07 ' 03" East 190. 00 feet; thence <br /> N 00° 15 ' 19" West 240. 00 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10. 255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> (A) Residential use of the property shall be limited to no more <br /> than a triplex. <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of land within 300 feet <br /> of the site. Failure to record the restrictions will cause the <br /> rezone to be null and void. <br /> A copy of the recorded document - - - Dane County <br /> Zoning. <br /> CO P ION: <br /> 1. - The rezone shall be effective upon the execution of an <br /> agreement with the Town of Dunn which specifies that the <br /> property owners, Juliun R. Atkinson and/or Agnes H. Atkinson, <br /> their heirs, assigns or representatives, will make application <br /> to rezone the property to single family or duplex zoning at <br /> such time they no longer reside on the property. A copy of <br /> said agreement shall be recorded at the Dane County Register <br /> of Deeds office. <br /> EFFECTIVE DATE: <br /> CDP1 62° FUE 111711.16 <br /> (ZNRPH.REZ) <br />
