• DANE COUNTY ORDINANCE AMENDMENT NO. 6107 Amending Section 10. 03 relating to Zoning Districts in the Town of Madison The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Madison be amended to include in the C-1 Commercial District/s the following described land: Pet. #6107: Part of the SE 1/4 NE 1/4 Section 35, Town of Madison described as follows: Lot #3, CSM 1905 found in Volume 8, Page 11, of Certified Survey Maps Dane County Register of Deeds Office. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10. 255 (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REOUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: (A) Use of the property shall be limited to office building, or medical, or dental use. (B) Plans for the improvement of the property, e.g. , site or building, shall be submitted to the Town Board for review. Town approval shall be obtained prior to start of any project. (C) The building constructed on the property shall be one- story; shingles on roof; siding shall be horizontal or stucco or brick. (D) The building subsequently may be expanded only to the West and is limited to 650 square feet; the building may not be expanded to the North South or East. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. A copy of the recorded document shall be submitted to Dane County Zoning. EFFECTIVE DATE: (ZNRPH.REZ)
