y - <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6142 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Rutland <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Rutland be amended to <br /> include in the R-lA Residential District/s the following described <br /> land: <br /> Part of the SE 1/4 NE 1/4 Section 35, Town of Rutland described as <br /> follows: Commencing at the East quarter corner of said Section 35; <br /> thence N 88° 54' 31" West along the South line of said SE 1/4 NE <br /> 1/4 - 662 . 54 feet to the Southwest corner of Dane County Certified <br /> Survey Map number #2838 and the point of beginning; thence N 00° <br /> 21' 16" West along the West line of said Certified Survey, 685. 51 <br /> feet to the Northwest corner thereof; thence N 87° 51' 29" West, <br /> 266. 37 feet; thence S 00° 43 ' 27" East, 185 . 52 feet; thence S 87° <br /> 51' 29" East, 199 . 11 feet; thence S 00° 21' 16" East, 501. 26 feet <br /> to the aforesaid South line of the SE 1/4 NE 1/4 ; thence S 88° 54 ' <br /> 31" East along said South line, 66. 02 feet to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10. 255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on the property from which the above <br /> described rezone area is to be divided: <br /> (A) Subsequent to the separation of the Rezone Petition #6142 <br /> area from this property, no further divisions are <br /> permitted. <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of land within 300 feet <br /> of the site.
