<br /> WHEREAS, Mary Long a/k/a Mary L. Long, is the

<br /> Dare County, State of Wisconsin, to-wit:
<br /> The Northwest 1/4 of the Northeast 1/4 of Section
<br /> 30, Town 5 North, Range 11 East, Town of Dunkirk, V 2 9 5 2 2 P 2 7
<br /> Dane County, Wisconsin
<br /> WHEREAS, the undersigned, is in the process of Parcel Number-
<br /> rezoning a portion of said real estate and cr(aring a a —0511-301-85590-2 n
<br /> separate parcel with respect to such portion rezoned $So0 (7� •
<br /> from A-1 Exclusive Agriculture to R-1A Residential, with such separate parcel
<br /> being created by a Certified Survey Map, said new separate parcel being
<br /> described as follows:
<br /> A part of the Northwest 1/4 of the Northeast 1/4 of Section 30, T5N,
<br /> R11E, Town of Dunkirk, Dane County, Wisconsin, more fully described as
<br /> follows: Commencing at the North 1/4 corner of said Section 30; thence
<br /> East along the North line of the Northeast 1/4, 505.20 feet to the point
<br /> of beginning; theme continue East along said North line, 165.00 feet;
<br /> thence South, 293.50 feet; thence West, 165.00 feet; thence North,
<br /> 293.50 feet to the point of beginning.
<br /> WHEREAS, the undersigned, Mary L. Long, desires to place a certain
<br /> restriction upon the remaining lands after the creation of the new parcel to
<br /> •
<br /> be created and described above, with such restriction to bind undersigned and
<br /> those who may acquire title hereafter;
<br /> NOW, THEREFORE, for a valuable consideration, receipt of which is hereby
<br /> • acknowledged and in consideration of the mutual benefits passing to them from
<br /> the undersigned owner and those who may hereafter purchase said land or lands
<br /> and the parties named as beneficiary of these restrictions, the following
<br /> restrictions are hereby imposed upon the following described property:
<br /> The Northwest 1/4 of the Northeast 1/4 of Section 30, T5N, R11E, Town of
<br /> Dunkirk, Dane County, Wisconsin, except that part thereof described as tE
<br /> follows: Commencing at the North quarter corner of said Section 30;
<br /> thence East along the North line of the Northeast 1/4, 505.20 feet to
<br /> the point of beginning; thence continue East along said North line,
<br /> 165.00 feet; thence South, 293.50 feet; thence West, 165.00 feet; thence
<br /> North, 293.50 feet to the point of beginning.
<br /> 1. Subsequent to the separation of the excepted parcel described first
<br /> above from the said Northwest 1/4 of the Northeast 1/4 of Section 30, which
<br /> excepted parcel is the subject of Dana County Rezone Petition *6144, no
<br /> further divisions are permitted on the lands affected by this restriction.
<br /> 2. The restriction provided for herein shall be enforceable at law or
<br /> equity, during its term, against any party who has or acquires an interest in
<br /> the land subject to the restriction, by the following parties who ar named as
<br /> grantees, promisees, and beneficiaries with enforcement rights:
<br /> A. The county government of the County of Dane, Wisconsin, provided
<br /> that the lands affected hereby are under the jurisdiction of a
<br /> zoning ordinance of said county at the time the enforcement action
<br /> is commenced; and
<br /> B. The town government of the Township of Dunkirk, Dane County,
<br /> Wisconsin, provided that the lands affected hereby are within the
<br /> governmental jurisdiction of said town at the time the enforcement
<br /> action is commenced.
<br /> 3. The above restriction may be amended or terminated only upon the
<br /> approval of the zoning committee of the Dane County Board, Dane County,
<br /> Wisconsin, or its successor, or if such committee does not exist and there is
<br /> no successor, upon approval of the County Board of the County of Dane,
<br /> Wisconsin, and also, only upon the approval of the Town Board of the Township
<br /> of Dunkirk, Dane County, Wisconsin, or its successor. Written memoranda
