The applicable town/county policies are: <br /> 6. Petition for rezoning A-3 zoned properties within the Agricultural <br /> Preservation Category shall be considered by the Town only after findings <br /> are made based upon consideration of the following: <br /> a) Adequate public facilities to accommodate development either exist or will be <br /> provided within a reasonable time. <br /> b) Provision of public facilities to accommodate development will not place an <br /> unreasonable burden on the ability of affected local units of government to <br /> provide them. <br /> c) The land proposed for rezoning is suitable for development and development <br /> will not result in undue water or air pollution, cause unreasonable soil <br /> erosion or have an unreasonably adverse effect on rare or irreplaceable <br /> natural areas. <br /> Standards and Policies for Rezoning Lands in the Agricultural Transition Category <br /> 7. In addition to the requirements listed in #6 above, petitions for rezoning <br /> lands in the Agricultural Transition Category from A-3 to other zoning <br /> districts shall only be considered for approval by the Town if all of the <br /> following criteria are met: <br /> a) The activity allowed by the proposed rezone will not convert land that has <br /> been devoted primarily to agricultural use. <br /> b) The activity allowed by the proposed rezone will not limit the surrounding <br /> land's potential for agricultural use. <br /> c) The activity allowed by the proposed rezone will not conflict with agricultural <br /> operations on the land subject to a farmland preservation agreement. <br /> d) The activity allowed by the proposed rezone will not conflict with agricultural <br /> operations on other properties. <br /> 8. Any proposals to rezone lands in the Agricultural Transition Category from <br /> A-3 shall comply with the one dwelling unit per 35 acres of contiguous land <br /> owned density limitation. In no circumstance shall development in the <br /> Agricultural Transition Category exceed a density of one dwelling unit per <br /> 35 acres of contiguous land owned. <br /> While this is a conditional use, as opposed to rezone, the impacts of the change of use are the <br /> same as a rezone. The town should make some finding of adequate public facilities. The site is <br /> 71 acres, which has been cropped in 1994. While the soils appear less productive, the site has <br /> been devoted to agricultural use. Unused areas could be kept in agricultural production. This <br /> site (71 acres) is very large and, depending on the site design, negative impacts to surrounding <br /> farmland could be mitigated. <br />
