<br /> WHEREAS, Oliver E. Nelson, Jr. and Garda K. Nelson, husband and wife,
<br /> are owners of the following described real estate in Dane County, State of
<br /> Wisconsin, to-wit: Q

<br /> Parts of the Southeast 1/4 of the Northeast 1/4, the Southwest 1/4 of
<br /> the Northeast 1/4 and the Northeast 1/4 of the Southeast 1/4, lying West
<br /> of Barlow Road, all !n Section 17, Town 7 North, Range 7 East, Township
<br /> of Cross Plains, Dane County, Wisconsin.
<br /> WHEREAS, the undersigned, Oliver E. Nelson, Jr. and Cerda K. Nelson,
<br /> hereinafter Grantor, desire to place certain restrictions upon said lands, to
<br /> bind the owner and those who may acquire title hereafter;
<br /> NOW, THEREFORE, for a valuable consideration, receipt of which is hereby
<br /> acknowledged and in consideration of the mutual benefits passing to and from
<br /> the owner and those who may hereafter purchase said land or lands and the
<br /> parties named as beneficiary of these restrictions, the following restrictions
<br /> • are hereby imposed:
<br /> 1. Construction of buildings in the tillable are of the above
<br /> described Lot 1, of Certified Survey Map No. 7...7 .47. , is prohibited.
<br /> • 2. Subdivision of Lot 1, CSM No. _ for the purpose of
<br /> accommodation of another rer.idence is pro ibited for a period of twenty (20)
<br /> years from the date hereof, whereupon this restriction will expire.
<br /> ,. The restrictions provided for herein shall be enforceable at law or
<br /> equi'j, during the term, against any party who has or acquires an interest in
<br /> the land subject to the restriction, by the following parties who are named as
<br /> • Crrntees, promisees, and beneficiaries with enforcement rights: //
<br /> A. The owners of record of the said Lot 1, CSM No. Z, J��-,
<br /> • which is subject to the restrictions above set forth.
<br /> B. The county government of the County of Dane, Wisconsin.
<br /> C. The town government of the Township of Cross Plains, Dane
<br /> County, F'isconsin.
<br /> 4. The above restrictions may be amended or terminated by written
<br /> agreement of all of the owners of record of the said Lot 1, CSM No.
<br /> but only upon written approval of the Zoning Committee of the Dane County
<br /> Board, Dane County, Wisconsin, or its successor, or if such committee does not
<br /> exist and there is no successor, upon approval of the County Board of the
<br /> County of Dane, Wisconsin, and also, only upon written approval of the Town
<br /> • Board of the Township of Cross Plains, Dane County, Wisconsin, or its
<br /> successor.
<br /> THE FOLLOWING EASEMENTS ARE CREATED:

<br /> 5. There is hereby created a perpetual, nonexclusive access easement ,-
<br /> for ingress and egress over and across that portion of Lot 2, CSM No. 7
<br /> as set forth in said Certified Survey Map and labeled "INGRESS - EGRESS
<br /> FASEMENT OVER LOT 2." The purpose of this easement is to provide ingress and
<br /> egress from Barlow Road to the above described lands of Grantor lying west of
<br /> the said Lot 2 in the Southeast 1/4 of the Northeast 1/4 and the Northeast 1/4
<br /> of the Southeast 1/4, Section 17, T7N, R7E, Township of Cross Plains, Dane
<br /> County, Wisconsin.
<br /> Grantor reserves to Grantor, for him, her, and them, their tenants,
<br /> servants, visitors, and licensees, in common with the owners of said Lot 2,
