. l <br /> JOINT DRIVEWAY <br /> AGREEMENT <br /> AND EASEMENT <br /> Document Number <br /> WHEREAS, Mark A. Halverson. JoAnn M. Halverson. Perry J. <br /> Halverson and Julie A. Halverson (hereinafter referred to as <br /> Halversons) are the owners of the property referred to herein as <br /> "Parcel 1- and legally described on Exhibit "A" attached hereto and <br /> incorporated herein; and <br /> WHEREAS, Halversons have commissioned a Certified Survey <br /> to separate out a parcel of land from Parcel 1, which is referred to as <br /> "Parcel 2" herein and is legally described on said Exhibit "B"; and <br /> WHEREAS, the farmland on Parcel 1 has historically been and <br /> will continue to be accessed through the area which also serves as the <br /> driveway for Parcel 2 and then on and over the existing graveled Return to: <br /> drive which extends through Parcel 2 to the farm field to the west Behling Law Office <br /> thereof; and P.O. Box 15 <br /> WHEREAS, Halversons intend to sell Parcel 2 to a third party, Cambridge, WI 53523 <br /> but wish to retain such access over and through portions of Parcel 2 <br /> for the benefit of Parcel 1: and <br /> See Attachment. <br /> Parcel Identification Number(PIN) <br /> WHEREAS, in anticipation of such sale. Halversons wish to enter into a written agreement <br /> confirming that Parcel 1 has an easement for access purposes over and through portions of Parcel 2 and to <br /> ensure the continuation of such access for the joint use of Parcels 1 and 2 <br /> NOW, THEREFORE, it is hereby agreed as follows: <br /> In consideration of the mutual promises, covenants, and payments found herein and for other good <br /> and valuable consideration, the receipt of which is hereby acknowledged: <br /> 1. Halversons explicitly agree that this grant of easement shall survive the division of the <br /> properties and the closing on Parcel 2. <br /> 2. All references to the owners of Parcel 1 and to the owners of Parcel 2 herein shall include <br /> Halversons and the future owners of Parcel 1 and Parcel 2, their successors and assigns in title. <br /> 3. Halversons hereby grant to themselves as owners of Parcel 1 and their successors and assigns <br /> in title as the owners of Parcel 1 an easement and right-of-way to use that part of Parcel 2 <br /> described as the "Joint Driveway Easement Area" on Exhibit `'B"attached hereto and <br />
