DANE COUNTY ORDINANCE AMENDMENT NO. 6179 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Rutland <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Rutland be amended to <br /> include in the C-2 Commercial District/s the following described <br /> land: <br /> Pet. #6179: <br /> Part of the NE 1/4 SE 1/4 Section 1, Town of Rutland described as <br /> follows: Beginning at a point on the East line of said Section, 72 <br /> feet South of the Northeast corner of said NE 1/4 SE 1/4; thence S <br /> 86° 52 ' West 122. 4 feet; thence South parallel to the East line 21 <br /> feet; thence South 86° 52 ' West 76. 9 feet; thence South parallel <br /> to the East line, 69 feet; thence N 86° 52 ' East 199. 3 feet to the <br /> East line of said Section; thence North along said East line 90 <br /> feet to the point of beginning. Also, Lot one (1) , Certified <br /> Survey Map #1023, recorded in Volume 4 of Certified Survey Maps of <br /> Dane County, Page 296, Dane County Registry. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 <br /> (3) (a) 2. (b) of the Dane County Code of Ordinances . The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> A. As referred to in the Development Agreement between Robert II <br /> Dvorak, Laurie J. Dvorak, Gary J. Dvorak, Nancy J. Dvorak and the <br /> Town of Rutland dated 15 Feb 1995, paragraph 13 .c. (page 7) <br /> concerning the construction of a fence and gate to limit access by <br /> the public from the driveway referred to in the document. <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of land within 300 feet <br /> of the site. Failure to record the restrictions will cause the <br /> rezone to be null and void. <br /> A copy of the recorded document shall be submitted_to Dane County <br /> Zoning. <br /> EFFECTIVE DATE: 0/ " <br /> (ZNRPH.REZ) <br />
