RESTRICTIVE COVENANTS <br /> Return to: John A. Kassner <br /> P.O. Box 2019 <br /> Madison, WI 53701 <br /> Whereas, Paula J. Toltzien and Stephen P. Toltzien, husband and wife as <br /> survivorship marital property, are the owners of the following described land in the <br /> Town of Roxbury, Dane County, Wisconsin, to wit: <br /> Lots One (1) and Four (4), Certified Survey Map 1544, <br /> recorded in Vol. 6 of Certified Survey Maps, page 271, as <br /> document number 1411948, Dane County Registry. <br /> II. Whereas, the said owners have asked the Town of Roxbury to agree to rezone the <br /> above property from RH-3 to R-4 Multi-family in order to place not more than four <br /> single-family detached residences and the customary appurtenant residential <br /> structures for those single-family residences such as garages, boathouses and <br /> boat docks intended for the private, non-commercial use of the occupants of the <br /> four single-family detached residences on said lands. <br /> III. Whereas, the said owners desire to place certain restrictions thereon, to bind the <br /> owner and those who may acquire title hereafter, in order to assure the Town of <br /> Roxbury that said lands will not be used for a density greater than set forth herein <br /> or as the site of any duplex or multi-family dwelling. <br /> IV. Now, therefore, in consideration of the mutual benefits passing to and from the <br /> owners and those who may hereafter purchase said land and the parties named <br /> as beneficiaries of these restrictions, the following restrictions are hereby imposed: <br /> The use of the lands described above shall be limited to a condominium site <br /> permitting not more than four, single-family detached residences with customary <br /> appurtenant residential structures such as garages, boathouses and boat docks <br /> intended for the private, non-commercial use of the occupants of said single- <br /> family detached residences. <br /> V. These restrictions shall constitute covenants running with the land and shall be <br /> binding upon all parties now owning any part of said Land, their successors, heirs <br /> and assigns, and all parties holding under them unless, pursuant to paragraphs <br /> VII or VIII of this instrument, said restrictions are amended or terminated. <br />
