It follows that the <br /> Regional Planning Commission's interpretation of the Town Land Use <br /> Plan should not be substituted for that of the Town. Approving <br /> this petition allows the Town to plan for rural development that <br /> complies with and fits its land use plan, needs and preferences. <br /> For these reasons, the Regional Planning Commission's advisory <br /> comments must be disregarded; they are no basis for denying this <br /> petition because they exceed the authority of the RPC and usurp the <br /> power of the Town of Cross Plains. <br /> E. Grounds For Disqualification Of Town Supervisor Ken <br /> Ziegelbauer. <br /> (1) Mr. Niesen Is Entitled To A Fair Hearing On His Petition. <br /> Free From Prejudgment Or Bias Concerning The Issues. <br /> Mr. Niesen is entitled to a fair public hearing before <br /> the Town. Not only must the hearings be fair, they also must <br /> appear to be so. There are several recognized grounds for <br /> disqualifying persons performing quasi-judicial functions, such as <br /> a Town Supervisor, including: <br /> 1. prejudgment or bias concerning the issues involved; <br /> and <br /> 2 . an interest whereby a person stands to gain or lose <br /> by a decision either way (an interest that is not <br /> shared by the public generally and which is more <br /> than remote or speculative) <br /> (2) Town Supervisor Ziegelbauer Has A Private Interest In The <br /> Outcome Of This Petition Sufficiently Different From That Which He <br /> Holds In Common With The Town Public And Has Shown Prejudgment <br /> Concerning The Issues Involved. <br /> In this matter, Town Supervisor Ziegelbauer has crossed <br /> the line and has a private interest in the outcome of this petition <br /> sufficiently different from that which he holds in common with the <br /> Town public. He has shown prejudgment toward the issues. He <br /> resides at 4508 Oak Valley Road, Cross Plains, Wisconsin, in Oak <br /> Valley Estates. A copy of the petition he signed is attached as <br /> Exhibit B. His signing a petition opposing Petition No. 5898 <br /> evidences his private interest in the outcome of this rezoning and <br /> his prejudgment became an issue when he privately communicated with <br /> the County Executive respecting Petition No. 5898 . A copy of the <br /> letter he sent to the County Executive is attached as Exhibit C. <br /> On August 10, 1994, following the Dane County Board of Supervisor's <br /> adoption of Petition No. 5898 but before the County Executive <br /> vetoed it, Town Supervisor Ziegelbauer wrote to the County <br />
