Virnig, requesting a <br /> zoning change from Al to A-B and LC-1 for a Landscape and Garden <br /> Contractor Center, West of 8200 Stagecoach Road, Section 11, T7N, <br /> R7E, Town of Cross Plains. <br /> Dear Mr. Anderson <br /> Please be advised that the 3.3 acre parcel subject to the Zoning Petition is within the <br /> approved boundaries of the Black Earth Creek Fishery Area. The stated goal of the Black <br /> Earth Creek Master Plan is "to obtain land control and to manage, preserve and protect <br /> designated property within the boundary of the Black Earth Creek Fishery Area in Dane <br /> County; to enhance trout fishing and other recreation and educational activities while <br /> perpetuating or restoring the scenic and aesthetic qualities of the streams." As you know, <br /> the approved master plan went through a public review process and is used to guide <br /> Departmental action and management of the stream corridor within the Fishery Area <br /> boundary. <br /> Since the State has invested a considerable amount of time and funding in the protection <br /> of this stream, we are concerned about any land use change which may have negative <br /> impacts on water quality, the outstanding trout fishery, and associated flora or fauna. <br /> Much of this investment has taken the form of volunteer donations of time and money. <br /> In terms of water quality, the Department is particular concerned about the use of <br /> pesticides and fertilizers and the resultant possible negative impacts on water quality. <br /> The Dane County Zoning Committee should be aware of the following DNR concerns with <br /> this proposal which have a direct effect on the protection of the stream: <br /> • Construction erosion control <br /> • Protection of the stream from surface runoff and fertilizers <br /> • Safeguards for any fertilizer or pesticide spills <br /> I hope that the DNR's concerns have been clearly stated.
