• <br /> STATEMENT <br /> Rezone Petition No. ("Zov <br /> The applicant respectfully requests that (1) the County <br /> Zoning Committee find there are requisite grounds for re- <br /> submittal of this petition under s . 10 .255 (1) (c) of the <br /> Ordinances and (2) both the Town Board and the County Zoning <br /> Committee approve this petition subject to such site-specific <br /> conditions as may be acceptable to the applicant. <br /> It is our position there are grounds for re-submittal of <br /> this petition, including new arguments or evidence that this <br /> parcel should never have been covered by blanket A-1 exclusive <br /> agriculture zoning. Prior to the effective date of A-1 exclusive <br /> agriculture zoning, this parcel was not eligible or suitable for <br /> A-1 exclusive agriculture zoning under the applicable statutes <br /> and ordinances and, accordingly, should have been excluded from <br /> blanket A-1 exclusive agriculture zoning. This parcel should <br /> have been rezoned to allow rural development instead of covered <br /> by blanket A-1 exclusive agriculture zoning. If this parcel <br /> should not have been included in or covered by blanket A-1 <br /> exclusive agriculture zoning, it follows that land use policies <br /> and standards applicable to agricultural land preservation are <br /> inappropriate and irrelevant to rezoning this parcel . <br /> The proposed rezone will allow the subject parcel to be <br /> used for landscape contracting and garden center businesses. No <br /> time schedule for development is available at this time due to <br /> the circumstances. <br /> It is our position there are strong arguments supporting <br /> this petition and refuting the arguments opposing this petition. <br /> In brief, the proposed rural development, among other things: <br /> (1) is consistent with Town land use policies, <br /> (2) is beneficial to the Town public; <br /> (3) is consistent with agricultural and surrounding uses; <br /> (4) does not set a dangerous precedent for commercial <br /> development. <br /> The applicant reserves the right to submit and anticipates <br /> submitting to the Town Board and County Zoning Committee a <br /> position statement more fully detailing the arguments supporting <br /> this petition and refuting the arguments opposing this petition. <br /> We are concerned that Town Supervisor Ken Ziegelbauer may <br /> have a conflict of interest which prevents his involvement in the <br /> debate and we reserve the right to request Mr. Ziegelbauer's <br /> exclusion. <br />
