DANE COUNTY ORDINANCE PETITION NO. 6242
<br /> Amending Section 10. 03 relating to Zoning Districts in the Town of
<br /> Madison --
<br /> The Dane County Board of Supervisors does ordain as follows: That
<br /> the Zoning District Maps of the Town of Madison be amended to
<br /> include in the C-2 Commercial District/s the following described
<br /> land:
<br /> Pet. #6242 : \.
<br /> Part of the S 1/2 SE 1/4 Section 33, Town of Madison, described as
<br /> follows: Commencing at the Southeast corner of the SW 1/4 SE 1/4;
<br /> thence West on the South line of said SW 1/4 SE 1/4 66. 0 feet;
<br /> thence North parallel to the East line of said SW 1/4 SE 1/4, 530. 1
<br /> feet; thence East 410. 7 feet; thence South parallel to the East line
<br /> of said SW 1/4 SE 1/4, 49. 5 feet; thence East 125 . 0 feet; thence
<br /> South 480.2 feet to a point 472. 2 feet East of the Southwest corner
<br /> of the SE 1/4 SE 1/4; thence West on the South line of said SE 1/4
<br /> SE 1/4, 472. 2 feet to the point of beginning.
<br /> CONDITIONAL ZONING
<br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)
<br /> (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned area
<br /> shall be subject to the, following conditions.
<br /> DEED RESTRICTIONS REQUIRED
<br /> 1. Permitted uses. Notwithstanding the permitted uses designated for the C-2 Zoning
<br /> District, the permitted uses shall be expressly limited to the following:
<br /> a. Offices, office buildings and condominium office buildings.
<br /> b. Experimental laboratories, manufacturing, assembly plants, warehousing,
<br /> storage, distribution centers and wholesale businesses, provided that such uses shall be further
<br /> expressly limited and restricted to the present business interests of Epicentre Technologies
<br /> Corporation, which include: the isolation of protein from natural sources, research and
<br /> development, manufacture and sale of biotech reagents, kits, instruments, software and other
<br /> tools for basic research and analysis and other applications in biology, medicine and
<br /> agriculture, including diagnostics and pharmaceuticals. Notwithstanding the foregoing, this
<br /> restriction and limitation shall be interpreted to permit any other person or company which
<br /> operates a business which is substantially similar to the business operated by Epicentre
<br /> Technologies Corporation with respect to the intrusion and offensiveness to the neighborhood
<br /> related to volume of traffic, the level of noise, the presence of offensive odors, the
<br /> hazardousness of the business, hours of operation and/or any other detrimental factors which
<br /> would constitute a nuisance. This restriction and limitation is established to provide an
<br /> aesthetically attractive working environment exclusively for and conducive to the development and
<br /> protection of offices, research and development institutions, and certain specialized
<br /> manufacturing establishments, all of a non-nuisance-type. The essential purpose of the foregoing
<br /> is to achieve development which is practical, feasible and economical and an asset to the owners,
<br /> heighbors and the community and to promote and maintain desirable economic development activities
<br /> in a natural setting. No use shall be conducted as to cause the harmful discharge of any waste
<br /> materials into or upon the ground, into or within any sanitary or storm sewer system, into or
<br /> within any water system or water, or into the atmosphere. All uses shall be conducted in such a
<br /> manner so as to preclude any nuisance, hazard, or commonly recognized offensive conditions or
<br /> characteristics, including emission of dust, gas, smoke, noise not to exceed sixty-five (65)
<br /> decibels at the property line, fumes, odors, vibrations, particulate matter, chemical compounds,
<br /> electrical disturbance, humidity, heat, cold, glare, or night illumination.
