11 pF M9d <br /> Town of Madison <br /> 410 VOY 2120 Fish Hatchery Rd. •Madison,Wisconsin•53713 <br /> (' Department of Public Works•(608)257-0251 <br /> STAB. 1SN <br /> CONDITIONS OF APPROVAL FOR ZONING PETITION#6242 <br /> Related to the Petition of Epicentre Technologies Corporation, Petition #6242, to rezone the <br /> Williams farm property, located in the SE'/4 of the SE'/4 of Section 33 T7N R9E in the Town of <br /> Madison, from RH-1 to C-2, Epicentre Technologies Corporation agrees that the following <br /> restrictions and limitations be imposed by appropriate deed restrictions: <br /> 1. Permitted uses. Notwithstanding the permitted uses designated for the C-2 Zoning <br /> District,the permitted uses shall be expressly limited to the following: <br /> a. Offices,office buildings and condominium office buildings. <br /> b. Experimental laboratories, manufacturing, assembly plants, warehousing, <br /> storage, distribution centers and wholesale businesses, provided that such uses shall be further <br /> expressly limited and restricted to the present business interests of Epicentre Technologies <br /> Corporation,which include: the isolation of protein from natural sources, research and development, <br /> manufacture and sale of biotech reagents, kits, instruments, software and other tools for basic <br /> research and analysis and other applications in biology, medicine and agriculture, including <br /> diagnostics and pharmaceuticals. Notwithstanding the foregoing, this restriction and limitation shall <br /> be interpreted to permit any other person or company which operates a business which is <br /> substantially similar to the business operated by Epicentre Technologies Corporation with respect to <br /> the intrusion and offensiveness to the neighborhood related to volume of traffic, the level of noise, <br /> the presence of offensive odors, the hazardousness of the business, hours of operation and/or any <br /> other detrimental factors which would constitute a nuisance. This restriction and limitation is <br /> established to provide an aesthetically attractive working environment exclusively for and conducive <br /> to the development and protection of offices, research and development institutions, and certain <br /> specialized manufacturing establishments, all of a non-nuisance-type. The essential purpose of the <br /> foregoing is to achieve development which is practical, feasible and economical and an asset to the <br /> owners, neighbors and the community and to promote and maintain desirable economic <br /> development activities in a natural setting. No use shall be conducted as to cause the harmful <br /> discharge of any waste materials into or upon the ground, into or within any sanitary or storm sewer <br /> system,into or within any water system or water,or into the atmosphere. All uses shall be conducted <br /> in such a manner so as to preclude any nuisance, hazard, or commonly recognized offensive <br /> conditions or characteristics, including emission of dust, gas, smoke, noise not to exceed sixty-five <br /> (65)decibels at the property line, fumes, odors, vibrations, particulate matter, chemical compounds, <br /> electrical disturbance,humidity,heat,cold,glare,or night illumination. <br /> 1 <br />
