COMPOSITE REPORT - Page 2 APPLICATION NO.
STAFF COMMENTS
REGIONAL PLANNING
Petition 6243. This proposed division of a 71-acre parcel appears to conflict with the adopted town/county policy
in the Town of Oregon.
This area is designated "Agricultural Transition Area Category"on the plan map as adopted by the town in July
1994,and the County Board in December 1994. The relevant policy which applies to this area is as follows from
page 22:
"2. The maximum permitted residential density in this Category is one dwelling unit per 35
acres of contiguous land owned. Each parcel that is not contiguous to the balance of the
farm shall be treated separately in the density computation. In order to prevent the
occurrence of multiple land divisions by successive landowners, this density limitation
shall run with the land; shall be cumulative; and shall apply to those persons or entities
owning land within the town on the adoption of this provision, and to their grantees, heirs,
successors and assigns. The density limitation established by this policy shall be applied
until further study indicates a need to amend the plan."
With 71 acres in the parcel, two lots could be allowed, not three as requested. The intent of the transitional area is
to acknowledge areas which are currently agricultural, but may be needed for urban development.
The plan goes on to state Standards and Policies for Rezoning Lands i the Agricultural Transition Category and,
on page 24,there is the following statement:
"8. Any proposals to rezone lands in the Agricultural Transition Category from A-3 shall
comply with the one dwelling unit per 35 acres of contiguous land owned density
limitation. In no circumstance shall development in the Agricultural Transition Category
exceed a density of one dwelling unit per 35 acres of contiguous land owned.
This seems to clearly state the adopted policy for this case.
ENVIRONMENTAL HEALTH (septic, etc.)
No objection to this petition
DANE COUNTY HIGHWAY
NONE
OTHER
