COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> REGIONAL PLANNING <br /> Petition 6243. This proposed division of a 71-acre parcel appears to conflict with the adopted town/county policy <br /> in the Town of Oregon. <br /> This area is designated "Agricultural Transition Area Category"on the plan map as adopted by the town in July <br /> 1994,and the County Board in December 1994. The relevant policy which applies to this area is as follows from <br /> page 22: <br /> "2. The maximum permitted residential density in this Category is one dwelling unit per 35 <br /> acres of contiguous land owned. Each parcel that is not contiguous to the balance of the <br /> farm shall be treated separately in the density computation. In order to prevent the <br /> occurrence of multiple land divisions by successive landowners,this density limitation <br /> shall run with the land; shall be cumulative; and shall apply to those persons or entities <br /> owning land within the town on the adoption of this provision,and to their grantees, heirs, <br /> successors and assigns. The density limitation established by this policy shall be applied <br /> until further study indicates a need to amend the plan." <br /> With 71 acres in the parcel,two lots could be allowed, not three as requested. The intent of the transitional area is <br /> to acknowledge areas which are currently agricultural,but may be needed for urban development. <br /> The plan goes on to state Standards and Policies for Rezoning Lands i the Agricultural Transition Category and, <br /> on page 24,there is the following statement: <br /> "8. Any proposals to rezone lands in the Agricultural Transition Category from A-3 shall <br /> comply with the one dwelling unit per 35 acres of contiguous land owned density <br /> limitation. In no circumstance shall development in the Agricultural Transition Category <br /> exceed a density of one dwelling unit per 35 acres of contiguous land owned. <br /> This seems to clearly state the adopted policy for this case. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> No objection to this petition <br /> DANE COUNTY HIGHWAY <br /> NONE <br /> OTHER <br />
