Phelps <br /> Dane County Executi e <br /> DATE: November 13, 1995 <br /> RE: Veto of Zoning Petition #6255 <br /> Zoning Petition #6255 would permit David Stauffacher to change the <br /> zoning from the A-1 Agriculture Exclusive District to the C-1 <br /> Commercial District on 1.91 acres in the Town of Sun Prairie. In <br /> effect, the re-zoning would permit the continuing location of two <br /> businesses in the building known at the Mushroom Barn. <br /> I am vetoing this petition because intensive commercial uses of the <br /> sort represented in this petition are not appropriate to the <br /> agricultural preservation area of a town and because of questions <br /> of fairness. <br /> The location of this building is in the middle of an intensely <br /> farmed expanse in the Town of Sun Prairie's agricultural <br /> preservation area. As such, the town and Dane County land use <br /> plans prohibit most types of commercial development. It is true <br /> that the Mushroom Barn is a massive building and that the <br /> petitioner will have to find a use for it, but it is equally true <br /> the construction of the building was allowed without rezoning only <br /> because it was to be used exclusively for agricultural production. <br /> The fact of the building's existence should not be a decisive <br /> argument for the commercial re-zoning. <br /> The neighbors are intensely opposed to this re-zoning. Their <br /> strongest and a compelling argument is based on fairness. Many of <br /> these citizens have pointed out that as they have developed their <br /> farms and residences, they have had to comply with a number of <br /> regulatory processes regarding zoning, septic systems, driveways, <br /> etc. They think it unfair to grant the re-zoning when the <br /> petitioner, who was in a position to know the applicable zoning <br /> regulations, ignored, them and started two businesses without <br /> complying with the relevant and reasonable regulations.
