The points of <br /> consideration were: <br /> 1. The building on the site for which the rezoning is being sought is an existing Nurucwre <br /> which was in agicuitural use from 1987 to 1991. The building has been virtually empty <br /> since 1991 The current owner piirchaed the parcel during 1994, Early in 1995 Mi.. <br /> Stauffacher was cited for non-compliance in the A 1 Exclusive Asriculturel District. The <br /> structure was being used for activity which required a C-I zoning. <br /> 2- Application was made by the petitioner to rezone to C-1. Town Board held a public <br /> hearing on April 10, 1995, County Public Hearing was on April 11, 1995, The Town <br /> Board considered this petition,it's impact;the comments of the public and merits of the <br /> request at many Board meetings from April through August. <br /> 3. The Board recognized that the zoning change offered the opportunity for several issues <br /> to be addressed through the Developers Agreement. The developers agreement <br /> specifically covers road improvement to the Town Read and to the access area to C'1'II N. <br /> if the property were to be used for storage of agricultural products it is likely that heavier <br /> truck traffic would occur,the same safety issues would be of concern, but could not be as <br /> easily addressed,because Town Board and County approval may not be required. (Please <br /> refer to Developers Agreement supplied earlier.) <br /> 4. The building is existing. It is a very large structure with many tnns of concrete and <br /> cement block. The structure could be destroyed and landfilled. But in the Board's <br /> opinion this would he an unnecessary and unwise use of landfill space. The owner <br /> currently has two businesses which he owns occupying the structure. These appear to be <br /> relatively low impact businesses. Since the building can be used for financial gain, the <br /> owner will have the incentive.to repair and maintain the structure. The reverse would be <br /> litre for the structure if it were left empty,it would be allowed to deteriorate. <br />
