ALIG 22 '95 14: 12 TOWN OF SUN PRAIRIE __ <br /> -L :J r. 1n <br /> TOWN OF SUN PRAIRIT: oar <br /> DANE COUNTY,WTSCONSIN f� <br /> Developers Agreement for Public Improvements <br /> within the Town of Son Prairie <br /> This agreement is made,for good and valuable consideration,by and between the <br /> Town of Sun Prairie,Dane County, Wisconsin,(hereinafter called <br /> Stauffacher 4953 C11-1 N,Sun Prairie, WI 53590,hereinafter lei wL nr 3 as Developer.David <br /> 1. This agreement pertains to certain real estate located.at 49R7 CTH N in the <br /> Town of Sun Prairie. The legal description of the land involved is attached hereto as <br /> Exhibit A,and is hereinafter called the"Real.Estate." <br /> 2. The developer agrees to upgrade.~'alter Road using the commercial <br /> specifications as prescribed,by the Town Highway Development Ordinance and agreed to <br /> by the Town board. The Developer will furnish the Town with a set of plans for the <br /> construction of Faber Road. <br /> 3. The Building exterior is be refinished according to the rendering previously <br /> submitted to the Town Board and the exterior descriptions presented 7/25/95. Site <br /> improvements are to be completed in a good workmanlike manner according to the <br /> Development Plan drawn by TDT,Associates,Inc.,issued 7/19,95,as presented to the <br /> Town Board on 7/25/95 and$/14/95. <br /> 4. The Developer shall engage qualified contractors to install all <br /> improvements and signage specified by the Town Engineer and/or Town Board. All <br /> improvements on the Real Estate shall he undertaken at the expense of the Developer, <br /> unless some other provision is made for public participadon in said costs <br /> 5. Developer will pay for any costs or surcharges exacted by utilities for the <br /> underground installation of electric.telephone and cable television or communications <br /> services. <br /> 6. If deemed necessary. The Developer shall submit an erosion control plan <br /> for review by the Town Board and the Dane County Land Conservation Corn'iiittre. <br /> 1. <br /> The Developer shall reimburse the Town for the legal,engineering and <br /> administrative costs incurred by the Town in reviewing the proposed development plan for <br /> the Real Estate. <br />
