DANE COUNTY ORDINANCE AMENDNONT NO. 6255 <br /> Amending Section 10. 03 relating to' Zoning Districts in the Town of <br /> Sun Prairie <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Sun Prairie be amended to <br /> include in the C-1 Commercial District/s the following described <br /> land: <br /> Pet. #6255: <br /> Part of the NE 1/4 NW 1/4 Section 33, Town of Sun Prairie described <br /> as follows: Commencing at the North quarter corner of said Section <br /> 33; thence S 85° 50 ' 00" West, 650. 59 feet to the East line of <br /> Certified Survey Map #1132; thence S 00° 14 ' 00" East along the <br /> East line of Certified Survey Map #1132, 600. 60 feet to the <br /> Southeast corner of said Certified Survey Map #1132; thence S 85° <br /> 50' 00" West along the South line of Certified Survey Map #1132, <br /> 208 .43 feet; thence S 03° 52 ' 00" East, 27 . 04 feet to the point of <br /> beginning; thence S 03° 52 ' 00" East, 518 . 00 feet; thence S 85° 50 ' <br /> 00" West, 161 . 80 feet; thence N 03° 52 ' 00" West, 518 . 00 feet; <br /> thence N 85° 50 ' 00" East, 161 . 80 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restriction (s) on said lands : <br /> 1. To prohibit Dane County from issuing permits until the <br /> development agreement is approved by the Town of Sun <br /> Prairie and Mr. David Stauffacher <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of land within 300 feet <br /> of the site.
