Therefore,the delineation bs
hereby approved as submitted.
Navigable Water: During our inspection,I noted that approximately the first 150 feet of a ditch
that begins at the Yahara River and ruts through the property had a defined bed and bank and
meets the definition of a navigable water of the state.
Navigable waters are regulated under chapters 30&31, Wisconsin Statutes. Activities that
require permits include but are not limited to, stream bank improvement, culvert crossings, pond
construction, storm sewer outfalls and grading more than 10,000 square feet on an un-interrupttd
slope to the creek. For more information about the activities that are regulated under chapter 30,
Wis. State and for copies of the associated permit applications, consult the 1NR web page at:
http:/,www.dnr.statee.wi.us/org/water/S2p/waterway/index.htm .
Zoning: I also recommend that you check with all zoning regulations that apply to
developments in Dane County. Many communities have established zoning regulations more
progressive than the minimum state standards. For instance, some counties, cities and villag»li
have elected to establish building setbacks for isolated wetlands(including Dane County). The%-:
setbacks create natural buffer zones, which are vital in maintaining a healthy wetland and one4n
protect the quality of water in our lakes and rivers. Lands annexed from the county after May 7,
1982 are required to continue to comply with county ordinances per ch. S9.69(7)Wis, Stats.
