Raemisch and Sons, Inc. , a Wisco'hsin corporation (the <br /> "Operator") and the Village of Waunakee, a municipal corporation <br /> (the "Village") . <br /> W I T N E S S E T H : <br /> WHEREAS, the Operator presently owns and operates a gravel <br /> quarry in the Town of Westport, Dane County, Wisconsin, at the site <br /> identified as the "Gravel Pit" on the map attached as Exhibit A, <br /> incorporated herein; and <br /> WHEREAS, the Operator has previously applied to the Dane <br /> County Zoning and Natural Resources Committee for a conditional use <br /> permit to allow for the expansion of the Operator's gravel quarry <br /> operations upon adjacent lands; and <br /> WHEREAS, the Dane County Zoning and Natural Resources <br /> Committee has previously issued to the Operator, Conditional Use <br /> Permit No. 1026 to allow for such expansion; and <br /> WHEREAS, the Operator has again applied to the Dane County <br /> Zoning and Natural Resources Committee to change the zoning of an <br /> expansion area from A-1 Exclusive Agricultural District to an A-2 <br /> Agricultural District and for the issuance of a Conditional Use <br /> Permit (No. 1133) to allow for quarrying operations upon the <br /> expanded site; and <br /> WHEREAS, the area of expansion consists of approximately 7 . 3 <br /> acres within the Town of Westport and adjacent to the corporate <br /> limits of the Village which area is shown as the "Proposed Quarry <br /> Expansion Area" (the "Expansion Area") on Exhibit A; and <br /> WHEREAS, the Village has previously notified the Dane County <br /> Zoning and Natural Resources Committee that it objects to the <br /> rezoning and to the issuance of the conditional use permit for the <br /> site for a number of reasons which are reflected in documents on <br /> file in said proceedings before the Dane County Zoning and Natural <br /> Resources Committee; and <br /> WHEREAS, the Operator has volunteered to address the concerns <br /> raised by the Village so that the Village may withdraw its <br /> opposition to the granting of the rezoning and the issuance of a <br /> Conditional Use Permit; and <br /> WHEREAS, the Village is willing to withdraw its opposition <br /> only upon the terms and conditions set forth herein. <br /> 1 <br /> /7. <br />
