V. <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 5901 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Dunkirk <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Dunkirk be amended to <br /> include in the RH-2 and RH-3 Rural Homes the following described <br /> land: <br /> Part of the NE 1/4 SW 1/4 and NW 1/4 SW 1/4 Section 16, Town of <br /> Dunkirk described as follows: <br /> TO RH-2 : Commencing at the West quarter corner of said Section <br /> 16; thence East, 758 feet to the centerline of CTH N; thence S 05° <br /> West along said centerline, 66 feet to the point of beginning; <br /> thence continue S 05° West along said centerline, 1188 feet; thence <br /> East 473 feet; thence N 05° East, 1188 feet; thence West, 473 feet <br /> to the point of beginning. <br /> TO RH-3: Commencing at the West quarter corner of said Section <br /> 15; thence East, 758 feet to the centerline of CTH N and the point <br /> of beginning; thence continue East, 1160 feet; thence S 01° West, <br /> 625 feet; thence West, 730 feet; thence N 05° East, 568 feet; <br /> thence West, 473 feet to the centerline of said CTH N; thence N 05° <br /> East, 66 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10. 255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for <br /> which a certified survey map will be prepared for approval and <br /> recorded. This amendment will become effective, if within 90 days <br /> of its approval by Dane County, a certified survey map that <br /> describes the land to be rezoned is recorded in the office of the <br /> Dane County Register of Deeds. Failure to record the survey will <br /> cause the rezone to be null and void. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on the land from which the above described <br /> areas are proposed to be separated from. <br /> A. The property from which the above described rezone is to <br /> be separated shall not be further divided. <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of the land.
