The legal description of the property as stated on our <br /> last tax bill is R978/21 SEC 19-7-12 PRT W1/2 SW1/4 NE1/4 THE N 770 FT OF E 170 FT THE <br /> EXC TN RD DESCR IN D444/373 & EXC R1961/15. <br /> While in the process of refinancing our home to borrow money to build a garage, we were required to <br /> have an appraisal done. The appraiser, Dena Detry of Goulette Appraisal Co., found that our property <br /> is not a legal, conforming parcel and that it has never been registered. In the nearly sixteen years in <br /> which we have owned this property, we have been appraised for a mortgage, been approved for two <br /> mortgages, and received a building permit for a previous addition but never found out before that we <br /> are not zoned correctly. <br /> We are applying for Residential 3 zoning so that we may attach a garage to the south side of our <br /> house toward the rear of our house. Our well is directly south of our house and its location precludes <br /> addition of the garage directly south of the house. The back, southwest corner of the house is now <br /> 50.5 feet from the property line. The house is not set parallel to the property line. Therefore, if the <br /> line of the back of the house were continued to the south, it would get closer to the west property line <br /> the farther south it goes. If the garage is twenty-four feet deep with only four feet overlapping the <br /> house because of the well and twenty feet behind the house, the southwest corner of the garage will <br /> certainly be closer than the thirty-five feet restriction of Residential 2 zoning and close to the twenty- <br /> five feet restriction of Residential 3. We have asked the owners of the property to our south and west, <br /> Terry and Joanne Jones, if they would sell us enough land to be able to meet a fifty foot restriction. <br /> Although they did not want to sell us any of their land, they did express that they have no objection to <br /> our putting a garage twenty-five feet from their property line. <br /> If we receive a zoning change to Residential 3, we would begin construction of the garage this spring. <br /> If I can provide any other information which you may need in this rezoning process, please contact <br /> me at the above address or telephone numbers.
