Date of filing of this appeal: 6/9/94 <br /> 4. Standing of appellant: Appellant is the owner of property <br /> immediately adjoining the property included within CUP No. <br /> 1132 . He owns and operates an existing business that will <br /> be adversely affected by approval of the CUP. <br /> 5. Grounds for the appeal in respect to the finding of the <br /> zoning committee: <br /> A. That Finding No. 2 is in error in that the appellant's <br /> property immediately adjoining the subject property is <br /> zoned for business use. The appellant has placed the <br /> property into the use of organic produce wholesaling, <br /> with intent to add retailing within the next several <br /> months. Retailing will occur through an outdoor stand, <br /> all of which is consistent with the applicable zoning. <br /> A combination of dust that will be generated by the <br /> approved conditional use and truck traffic, particular- <br /> ly truck traffic accessing the county's property from <br /> CTH N, will be a serious impairment to the use, value <br /> and enjoyment of the DuPre property. <br /> B. That the conditional use permit fails to support <br /> findings of fact No. 1 through 6 in that it fails to <br /> include a condition voted by the zoning committee that <br /> clay cannot be extracted from the southerly portion of <br /> the site until subsequent specific approval is given by <br /> the Dane County Zoning Committee. <br />
