• <br /> - RESTRICTIONS <br /> WHEREAS, VIRGIL P. RUHLAND and JEANETTE J. RUHLAND, husband <br /> and wife, and each in his or her own right, are the owners of the <br /> following described land in the Town of Black Earth, Dane County, <br /> Wisconsin, to-wit: <br /> Part of the SW 1/4 NW 1/4 Section 22, Town of Black Earth <br /> described as follows: Commencing at the East quarter <br /> corner of said Section 22; thence West 4188.64 feet along <br /> the East-West quarter line; thence N 03 degrees 46" West, <br /> 175.47 feet to the point of beginning; thence N 03 <br /> degrees 46 ' West, 175.00 feet to a point on the South <br /> right-of-way line of Olson Road; thence S 83 degrees 35 ' <br /> East, 127 .00 feet along said right-of-way line; thence <br /> S 03 degrees 46 ' East, 175.00 feet; thence N 83 degrees <br /> 35 ' West, 127 .00 feet to the point of beginning. <br /> WHEREAS, said owners desire to place certain restrictions <br /> thereon to bind the owner and those who may acquire title <br /> hereafter. <br /> NOW, THEREFORE, in consideration of the mutual benefits <br /> passing to and from the owner and those who may hereafter purchase <br /> said land and the parties named as beneficiaries of these <br /> restrictions, the following restrictions are hereby imposed: <br /> 1. USES <br /> (a) Commercial use of the property shall be limited to <br /> a dry-wall contractor business. <br /> (b) Construction of new buildings for the commercial use <br /> is prohibited. <br /> These restrictions shall constitute covenants running <br /> with the land and shall be binding upon all parties now <br /> owning any part of said land, their successors, heirs and <br /> assigns, and all parties holding under them unless, <br /> pursuant to paragraphs 3. or 4 . of this instrument, said <br /> restrictions are amended or terminated. <br /> 2. ENFORCEMENT - The restrictions provided for herein shall <br /> be enforceable at law or equity against any party who has <br /> or acquires an interest in the land subject to the <br /> restriction by the following parties who are named as <br /> grantees, promises and beneficiaries with enforcement <br /> rights: <br /> (a) The County Government of Dane County, Wisconsin <br /> provided that the lands are under the jurisdiction <br /> of zoning ordinance of said County at the time the <br /> enforcement action is commenced; and <br />
