COMPOSITE REPORT - Page 2 APPLICATION NO. STAFF COMMENTS REGIONAL PLANNING CUP 1444. This proposed dog kennel site had previously been used as an auto wholesale location. The relevant town/county policy in the Town of Rutland is: "3. To limit any non-agricultural commercial or recreational use to small, rural-oriented businesses which provide services needed by residents of the town. Such uses must meet the following criteria prior to zoning approval. • Be consistent with agricultural policies for farmland preservation. • Have access to a state or county highway. • Shall not adversely affect the traffic capacity and safety of the highway. • Provide a buffer between the commercial use and any adjacent non-commercial use. • Not endanger the environment of the area. • Require a septic tank no larger than 1,450 gallons. The size of the septic tank system may be limited to a lesser amount at the Town Board's direction." Staff Comments This is a use change;therefore,no rezoning is required. Use of farmland is not an issue since this was a previously developed site. Dog kennels tend to be more compatible in agricultural areas rather than urban areas. - The site has access to State Highway 92. - The highway appears capable of handling this level of traffic. - The site is approximately 1/4 mile from the nearest house. Other houses in the area are primarily to the north of STH 92. - Conditions for waste disposal should control environmental concerns. - This use could be accommodated without a septic tank unless there is a restroom facility onsite.
