Subject to existing public highway. <br /> DECLARATION made this 12 day of ,/a , 1994, by Daniel L. <br /> Millard and Lisa A. Millard, husband and wife, as follows: <br /> WITNESSETH : <br /> WHEREAS, Daniel L. Millard and Lisa A. Millard (hereinafter "Millard"), are <br /> the fee title owners of the above-referenced real estate; and <br /> WHEREAS, the above-referenced real estate is zoned C-1 but Millard and the <br /> Town of Bristol want to restrict the above-referenced real estate to use for single- <br /> family residential purposes only; and <br /> WHEREAS, a Declaration of Covenant and Restriction was recorded with the <br /> Dane County Register of Deeds Office on July 25, 1994, in Volume 28016 of Records, <br /> Page 74, as Document No. 2619716; <br /> NOW, THEREFORE, Millard, for themselves, their heirs, personal <br /> representatives, successors and assigns, hereby declare that the above-referenced real <br /> estate is and shall be held, transferred, sold, conveyed and occupied subject to the <br /> following covenant and restriction: <br /> 1. The Declaration of Covenant and Restriction recorded July 25, 1994 <br /> above-referenced is hereby declared to be null and void and shall be and hereby is <br /> superseded by this Declaration due to the omission of certain provisions required by <br /> the governmental authorities to be included therein. <br /> 2. The real estate and any buildings or other improvements on the <br /> above-referenced real estate shall be used only for single-family residential purposes, <br /> or any uses incident thereto, notwithstanding the zoning district in which the real estate <br /> is located. <br /> 3. If Millard, or their heirs, personal representatives, successors or assigns <br /> shall violate or attempt to violate this Declaration, pursuant to Section 236.293 of the <br /> Wisconsin Statutes, the Town Government of the Town of Bristol, Dane County, <br /> Wisconsin, provided that the lands are within the governmental jurisdiction of said <br />
