These proposed activities -- motor vehicle sales and native wildlife <br /> rehabilitation -- are requested in an agricultural preservation area of the Town of Rutland, east of <br /> the Brooklyn urban service area. The relevant policy for this proposal is: <br /> 3. To limit any non-agricultural commercial or recreational use to small, rural- <br /> oriented businesses which provide services needed by residents of the town. Such <br /> uses must meet the following criteria prior to zoning approval. <br /> - Be consistent with agricultural policies for farmland preservation. <br /> - Have access to a state or county highway. <br /> - Shall not adversely affect the traffic capacity and safety of the highway. <br /> - Provide a buffer between the commercial use and any adjacent non-commercial <br /> use. <br /> - Not endanger the environment of the area. <br /> - Require a septic tank no larger than 1,450 gallons. The size of the septic tank <br /> system may be limited to a lesser amount at the Town Board's direction. <br /> Comment: Due to the uses permitted in the commercial zoning <br /> districts and the town's desire to limit the size of such operations, <br /> each rezoning will require a conditional rezoning to set specific <br /> limits. This also allows the town an opportunity to review any <br /> potential new or successive uses. <br /> Staff Comments on Criteria: <br /> - This is an existing 8-acre parcel with a house and shed. <br /> - There is access to STH-92, although the drive is over 1/4 mile long. <br /> - If conditions are imposed, there should not be much traffic impact. <br /> - This site is surrounded by undeveloped farmland. <br /> - This use does not appear to threaten the environment. <br /> - No additional septic tank system should be needed. <br /> If the vehicle sales are wholesale, confined to three vehicles at a time and kept within the existing <br /> building as indicated in the application, the impacts could be minimized. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> DANE COUNTY HIGHWAY <br /> OTHER <br />
