4 <br /> DANE COUNTY ORilINANCE AMENDMENT NO. 5981 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Burke <br /> The Dane County Board of Supervisors does ordain as follows: That <br /> the Zoning District Maps of the Town of Burke be amended to include <br /> in the R-4 Residential District/s the following described land: <br /> Part of the NW 1/4 NE 1/4 Section 19, Town of Burke described as <br /> follows: Lot #2 , CSM 5429 found in Volume 24, Page 379 CSM Maps <br /> Dane County Register of Deedsd Office. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10. 255 <br /> (3) (a) 2 . (b) of the Dane County Code of Ordinances. The rezoned <br /> area shall be subject to the following conditions. <br /> DEED RESTRICTIONS REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption <br /> by Dane County the owner or owners of the land shall record the <br /> following restrictions on said land: <br /> A. A maximum of 85 dwelling units is permitted. A combination of <br /> duplex (2 unit) structures and triplex (3 unit) structures may <br /> be utilized in achieving the maximum number of dwelling units. <br /> B. The access road servicing the duplexes shall be a continuous <br /> one-way-only thoroughfare having 2 intersections with Dennis <br /> Drive. One of the intersections shall be designated the <br /> ingress and the other shall be designated the egress for said <br /> road. <br /> C. The access road shall be constructed with a 28 foot wide <br /> pavement. All curves on the access road shall have a minimum <br /> radius of 34 feet in order to accommodate emergency vehicles. <br /> D. A sidewalk shall be provided on one side of the road outside <br /> of the required pavement. <br /> E. Parking shall be permitted on only one side of the access road <br /> and no parking shall be permitted on either side within the <br /> curved portions of the road. <br /> F. A separate parking area consisting of 15 additional parking <br /> spaces, over and above those required for the complex pursuant <br /> to the zoning ordinance, shall be provided and maintained. <br /> G. A disclosure statement shall be included in all condominium <br /> instruments stating "The Dane County Regional Airport is <br /> located 3500 feet, more or less, East of these premises" . <br /> Said restrictions shall run in favor of Dane County and the <br /> pertinent Town Board as well as the owners of land within 300 feet <br /> of the site.
